Definitions

Consumer: any natural person who is acting for purposes which are outside his trade, business, craft, or profession.

Products: all goods provided by Mellow Coffee Roastery, including but not limited to roasted coffee beans, coffee-making equipment, and accessories.


Application

These Terms and Conditions will apply to the purchase of the goods detailed in our quotation (“Goods”) by the buyer from Mellow Coffee Roastery.

Mellow Coffee Roastery is a company registered in The Netherlands under number 97538809 whose registered office is at Mellow Coffee Roastery, Schiehaven 15C, 3024 EC Rotterdam, The Netherlands.

Each Purchase Order placed by you (the buyer) for Goods and/or Services is subject to these standard purchase terms and conditions. You shall be deemed to have agreed to be bound by such terms by placing an order or by accepting purchased Goods (whichever comes first).

These Terms and Conditions and the quotation (together, the “Contract”) apply to the purchase and sale of any Goods between us and you, to the exclusion of any other terms that you try to impose or incorporate, or which are implied by trade, custom, practice, or course of dealing.


Interpretation

  • A business day is any day (between 09:00 and 17:00) other than a Saturday, Sunday, international holidays, or public holidays in the Netherlands.

  • The headings in these Terms and Conditions are for convenience only and will not affect their interpretation.

  • Words imparting the singular number include the plural and vice versa.

Goods

The description of the Goods is set out in our sales documentation, unless expressly changed in our quotation. You acknowledge that you have not relied upon any statement, promise, or other representation about the Goods other than those contained in writing.

We may make changes to the specification of the Goods to comply with applicable safety or statutory requirements.

Price

  • The price (“Price”) of the Goods is as set out in our quotation current at the date of your order, or as otherwise agreed in writing.

  • If the cost of the Goods to us increases due to factors beyond our control (including, but not limited to, material costs, labour costs, exchange rate fluctuations, duties, or delivery rate changes), we may increase the Price before delivery.

  • The Price excludes delivery costs and other applicable taxes unless otherwise stated

  • Discounts, if applicable, are at our discretion.

Return Policy

Article 1: Applicability
This return policy applies to all purchases made by consumers at Mellow Coffee Roastery, whether online via our website or offline.

Article 2: Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day the consumer acquires physical possession of the Goods.

To exercise the right of withdrawal, you must notify us (Mellow Coffee Roastery, Schiehaven 15-C (Schiehavenhallen), 3024 EC Rotterdam, email: info@mellowcoffeeroasters.com) of your decision to withdraw from this contract by an unequivocal statement (e.g., email or letter).

Article 3: Effects of Withdrawal
If you withdraw, we shall reimburse all payments received from you, including delivery costs, within 14 days of being informed of your decision. Refunds will be made using the same payment method unless agreed otherwise.

You must return the Goods to us without undue delay and in any event within 14 days from the day you communicate your withdrawal.

Article 4: Return Costs
You will bear the direct cost of returning the Goods.

Article 5: Exclusions
The right of withdrawal does not apply to:

  • Goods made to your specifications or clearly personalized.

  • Goods liable to deteriorate or expire rapidly (e.g., roasted coffee).

Article 6: Condition of Returned Goods
Returned products should be in original condition and packaging. Damaged or incomplete returns may not be fully refunded.


Payment

  • Payment must be made according to the invoice terms or any agreed credit terms.

  • You remain liable for payment even if delivery has not yet occurred or title has not yet passed.


Delivery

  • Goods will be delivered to the address provided in the order.

  • Delivery times are indicative and not of the essence.

  • If delivery is not accepted, we may charge for storage, re-delivery, or related costs.

  • Risk passes upon delivery; title passes upon full payment.


Inspection & Acceptance

  • You must inspect Goods upon delivery.

  • Any damages or shortages must be reported in writing within 14 days.

  • Use of the Goods after notice of defect will be deemed acceptance.


Risk & Title

  • Risk in the Goods passes to you on delivery.

  • Title remains with Mellow Coffee Roastery until full payment is received.


Limitation of Liability

Our liability is limited to the Price paid by you. We are not liable for indirect or consequential losses, loss of profit, or events outside our reasonable control. Nothing in these Terms excludes liability for death, personal injury, fraud, or any matter for which exclusion is unlawful.


Communications

All notices under these Terms must be in writing and sent to the latest address, email, or other contact details provided.


Force Majeure

We are not liable for delays or failures caused by events outside our reasonable control (including strikes, natural disasters, pandemics, war, government action, etc.).


Waiver & Severance

  • No waiver of a breach shall be deemed a waiver of any subsequent breach.

  • If any provision is found invalid, the remaining provisions remain enforceable.
